Punishment of the crime

On February 7, 2013, the Defendant was sentenced to the suspension of the execution of imprisonment with prison labor for six months at the Busan District Court on February 7, 2013, and the said judgment became final and conclusive on February 15, 2013.

1. [2014 Highest 1057] The Defendant, while working as an employee of a mobile phone agency of the trade name “D” in Kimhae-si, forged a new service contract, etc. using a copy of the former mobile phone subscribers’ identification card which was kept in the said agency in order to collect monthly mobile phone subscription quota, and submitted it to the telecommunications company and received the mobile phone and sold it to a third party.

On October 4, 2012, the Defendant stated “E” as “E40” and “904,200” in the name of the customer information column for the application for subscription of the new contract form of the SK Telecom Service Co., Ltd. at the aforementioned mobile phone agent with a black-type on October 4, 2012, and signed “E” on the document-based mobile phone agent’s name.

Accordingly, for the purpose of exercising rights, the Defendant forged a new service contract in the name of E, a private document on the duty of rights without authority.

B) On January 22, 2013, at the same place, the Defendant entered “E210” and “89,800” into the “E” model in the name of customer information column for application for subscription to the new service contract by the same method, and signed the “E” on the last day of the document. Accordingly, for the purpose of exercising rights, the Defendant forged one copy of a new service contract under the name of E, a private document on the duty of rights without authority. 2) The Defendant, at the same time and place, submitted one copy of the new service contract under the name of E, a private document on the duty of rights, and submitted it to the person in charge of the victim Ste Telecom Co., Ltd., who knows that the new service contract under the above forged name was forged, and the E actually paid a fee.
