A defendant shall be punished by imprisonment for not less than eight months.

[2013고단2289] 피고인은 C과 합동하여, 2013. 6. 2. 20:26경 부천시 소사구 D에 있는 피해자 E 운영의 ‘F’ 화장품 매장에서, 피해자에게 마치 화장품을 살 것처럼 포장해 달라고 요구하여, 피해자의 감시가 소홀한 틈을 타, C은 망을 보다가 위 매장에 진열되어 있는 피해자 소유의 시가 43,000원 상당의 링클스팟 에센스 1개, 시가 15,000원 상당의 오데퍼퓸 1개 등 합계 58,000원 상당의 화장품을 가지고 나오고, 피고인 A는 위와 같은 방법으로 피해자 소유의 시가 14,000원 상당의 올리브로션 2개, 시가 20,000원 상당의 윤광멜팅 1개, 시가 29,000원 상당의 씨드세럼 1개, 시가 7,000원 상당의 핸드크림 1개, 시가 18,000원 상당의 BB크림 1개 등 합계 102,000원 상당의 화장품을 가지고 나와 이를 절취하였다
