Reasons
Punishment of the crime
On December 17, 2019, the Defendant registered as a preliminary candidate for the National Assembly member of the B political party C on December 17, 2019, and went out as a candidate for the B political party in the 21st National Assembly member on April 15, 2020, and was successful.
1. A person who intends to be a candidate for a joint election with D shall not make a contribution act to a person in the relevant constituency or a person having relations with the electorate even though he/she is located outside the relevant constituency, and no one shall distribute, post, spread, play, show or run any advertisement, letter of personnel management, poster, photograph, document, picture, picture, printed matter, recording tape, and others similar thereto, which indicate the name of a political party or the name of a person who intends to be a candidate, without going through the Public Official Election Act, in order to influence the election, from 180 days before the election day to the election day;
On December 18, 2019, at around 02:34, the Defendant received mobile phone text messages stating, “I am 10 books. I will send only one ticket to a private person and be able to send it under the name of an organization with disabilities in the area of nine local constituency,” and around 15:24 on December 20, 2019, the Defendant sent to eight representatives of an organization with disabilities, including H branch I, at the G post office located in Gangwonwon F, with eight representatives of an organization with disabilities, the market value of which is 120,000 won in total.
As a result, the defendant conspired with D to make contributions to 8 branches of disabled groups in the constituency concerned, and at the same time, distributed 8 copies of the above book, a document indicating the name of the defendant who wishes to be a candidate in a manner that does not conform to the Public Official Election Act in order to influence the election.
2. The defendant's sole criminal conduct;
