A In the election of the 20th National Assembly member, which was implemented on April 13, 2016, registered as a preliminary candidate in the election for the 20th National Assembly member, on February 2, 2016, after entering the election district D as a preliminary candidate, and tried to carry out the said F election campaign by holding the position of the head of the special election campaign headquarters of F who was elected as a candidate for the E political party, and Defendant B was a person who has attempted to carry out the said F election campaign by holding the position of the head of the F

1. No co-principal of the Defendants may make a contribution on behalf of a person who wishes to be a candidate for an election.

Nevertheless, at around 12:00 on February 24, 2016, the Defendants conspired to provide meals to the persons coming from the above F election campaign office, etc., and provided 50 persons, such as J, etc. in the above election district, with food equivalent to KRW 436,50,00 in total, while the son of the above F was present, at the restaurant of “H” located in Gwangju Metropolitan City G, G, including J, etc. in the above election district.

As a result, the Defendants conspired to make contributions to the election of the 20th National Assembly member on April 13, 2016 for the F.

2. No one may distribute printed matters indicating the names of persons intending to become candidates without following the provisions of the Public Official Election Act, in order to influence the election from 180 days before the election day to the election day.

Nevertheless, on February 2016, the Defendant distributed five copies of the name cards stating the “Preliminary Candidates for the EF National Assembly Members (D) supporters’ association B” to the participants who found a place at a regular L regular meeting held by the community credit cooperatives located in Gwangju Metropolitan City K in Gwangju Metropolitan City.

Accordingly, the defendant distributed printed matters indicating the name of F in the 20th National Assembly member election rather than according to the Public Official Election Act in order to influence the election.
