Punishment of the crime

On May 12, 2010, the Defendant entered into a contract for the new construction of factories on E and F ground E and F in Yangju-si Co., Ltd. of the Victim C operation, and agreed to pay for the construction cost as part of the construction cost by calculating the price of the Defendant’s sand site board (360 square meters, 2-dong store), 5 metric tons at the price of the maximum of 43,000,000 won in each Gyeonggi-si.

According to the above construction contract, the victim was approved to use the building from both main viewers on October 25, 2010 after completing the construction work, but only KRW 650,052,90 from the Defendant until December 6, 2010, and did not receive the remainder of KRW 134,947,10.

Therefore, on December 7, 2010, H determined the total outstanding amount of the above construction work as KRW 151,80,000 (including additional tax) and agreed on payment in kind including approximately 15 tons in the sand position panel of the defendant company and approximately 43,000,000 won, which was originally scheduled for payment in advance, and payment in kind was made in excess of KRW 51,70,000 (including additional tax) which was 15,00,000 among the employment subsidies, and the difference was 85,10,000,000 (including additional tax) among the employment subsidies - 51,80,000 won - 51,70,700,000 won - - 15,000,000 won (including additional tax) which was settled to the victim by both the defendant and the victim.
