Punishment of the crime

[Criminal Power] In the Seosan Branch of the Daejeon District Court on July 7, 2017, the Defendant was sentenced to imprisonment with labor for one year for a violation of the Act on the Control of Narcotics, Etc., and the sentence becomes final and conclusive on July 15, 2017.

【Criminal Facts】

Despite the fact that the Defendant is not a narcotics handler, the Defendant dealt with the psychotropic drugs-related Mesofts (one philophone; hereinafter “philophones”), as follows:

1. Violation of the Narcotics Control Act;

A. On July 11, 2018, the Defendant, around July 11, 2018, received a request from B to allow philophone sellers using C to purchase philophones.

According to the above request, the Defendant, at around 19:32 of the same day, decided to contact the seller of the penphone in the name of the penphone (Cdiaphone) and to purchase the penphone, sent the F Association account (Account Number: G) in the name of E from the above person in the name of the victim, and continued to receive 400,000 won from B to the above account, and sent the deposit certificate to the above account without the name of the person in the name of the victim, and again, notified B of the receipt by transmitting the photo of the place where the penphone was hidden from the above person in the name of the victim.

As a result, the defendant assisted the trade of philophones between the above person in the name of the victim and B.

B. Around July 12, 2018, the Defendant attempted to sell or purchase phiphones, around 12:02 on July 12, 2018, the Defendant had J transfer 70,000 won to the F Association account (Account Number: G) in the name of E designated by the seller of phiphones (C) at the south branch of the I Association located in Seosan-si, Seosan-si, Seoul. At around that time, the Defendant attempted to purchase phiphones by finding out the phiphones which were concealed in advance by the person who was absent from his/her name at the place of the Guro-dong, Guro-gu, Seoul. However, the Defendant failed to find it.

Accordingly, the defendant tried to trade philophones, but attempted to do so.
