A defendant shall be punished by imprisonment for six months.

Punishment of the crime

[Criminal Power] The Defendant was sentenced to two years of suspended sentence in October 25, 2018 for the violation of the Act on the Control of Narcotics, Etc. in the Suwon District Court’s Ansan Branch on October 25, 2018, and the judgment becomes final and conclusive on November 2, 2018, and is currently under suspended sentence.

【Criminal Facts】

Despite the fact that the Defendant is not a person handling narcotics, the Defendant dealt with the psychotropic drugs-related Mesofts (one philophone, hereinafter “philophones”) as follows:

1. On June 12, 2018, the Defendant purchased and sold 400,000 won of the purchase and sale of phiphones from the automatic cash withdrawal machine in the vicinity of the C Station located in Seocho-gu Seoul Metropolitan Government to the virtual account (Account Number: Non-Account Number) designated by the D Bank E (FID 'G', 'H'). On June 13, 2018, the Defendant purchased and sold the phiphones by means of finding approximately 0.5 g of the phiphones, which was hidden in advance from the wall crepan of the J Building E in Ansan-gu, Ansan-si, Ansan-si, A around 04:55 on June 13, 2018.

2. On July 21, 2018, on July 21, 2018, at around 17:12, 2018, the Defendant: (a) transferred the price of KRW 400,000 to a virtual account of a bank in the name of K (Account Number: L) designated by the said E from the automatic cash withdrawal machine of a D bank near the C Station located in Seocho-gu Seoul Metropolitan Government; and (b) purchased and sold the phiphone by means of finding approximately 0.5g of the phiphone, which the said E was hidden in advance, at around 17:37 the same day.

3. On July 22, 2018, the Defendant administered philophones in a way that 0.2g of philophones were sent to the scopon in the Defendant’s residence located within the NAY-gu No. NA of Ansan-si around the middle of July 22, 2018, in a way that philophones are sent to the scopon.

4. Around September 14, 2018, the Defendant administered a philophone in a way that 0.2g of philophone in the residence of the above Defendant around the beginning of September 14, 2018.
