A defendant shall be punished by imprisonment for not less than one year and six months.

However, the execution of the above punishment shall be suspended for three years from the date of the final judgment.

Punishment of the crime

Although the Defendant was not a person handling narcotics, “2018 Highest 5610” dealt with psychotropic drugs, the Defendant treated the psychotropic drugs, as follows:

1. Trading and administration of philophones on or around May 9, 2018;

A. On May 9, 2018, at around 03:23, the Defendant: (a) transferred the amount of KRW 1.5 million to a bank account (H) in the name of G designated by the seller of the penphone in Songpa-gu Seoul Special Metropolitan City (Ediaphone “F”); (b) purchased and sold a penphone by finding approximately 1.5 g of the penphone, which was concealed in advance by the person who was absent from his name at the J University’s neighboring officetels located in Gwanak-gu Seoul Special Metropolitan City, Seoul Special Metropolitan City.

B. Around 1:00 on May 9, 2018, the Defendant administered phiphones by inserting approximately 0.05g of philopon into a single-use injection machine at K Hotel located in a non-fluoric place in Sungnam-si, Sungnam-si, and dilution with water, and administering philopon into the blood body.

2. On May 16, 2018, the Defendant attempted to sell or purchase phiphones, around 00:34, May 16, 2018, transferred the price of three million won to a bank account in the name of the said G bank designated by the said Cbank DF Center from the said CFD Center. The Defendant attempted to purchase phiphones by means of finding the phiphones concealed in advance at a place in which the said buphones were not known to the said buphones, but did not find the buphones because the said buphones were not known to the buphones.

Accordingly, the defendant tried to trade philophones, but attempted to do so.

3. On July 29, 2018, the Defendant attempted to sell or purchase a phiphone on July 29, 2018: (a) transferred the price of KRW 2 million to the Mbank account (O) in the name of G designated by the seller of the Ma Bank (E.N. hereinafter “N”) at the point of the Ma Bank (E.N.) city located in the Sungnam-si L, Sungnam-si, and the Defendant attempted to purchase the phiphone by means of searching for the phiphone in advance at a place where the buphone was not opened at that time; (b) however, the Defendant attempted to purchase the phiphone at a place where the buphone was named.
