A defendant shall be punished by imprisonment for three years.
For three years from the end of the sentence, the person against whom the probation order is requested.
Reasons
Punishment of the crime
1. On October 2013, the Defendant and the requester for probation order (hereinafter referred to as “Defendant”) committed an indecent act against the victim with mental disorder by inserting the victim’s scam, which is of intellectual disability Grade 2 in the victim D (the age of 25) at the smallest area of 303 Dong-dong 1206, Jung-gu, Gwangju, the Defendant’s residence, around the middle Saturday of October 2013, by inserting the Defendant’s pursuant to the following: (a) the victim’s scam, which is of intellectual disability 2; and (b) the victim resisting the victim’s chest; and (c) the victim resisting the victim by stating that the victim was “if you face”; and (d) by force, the victim’s chest was laid into two chests of the victim.
2. Violation of the Act on Special Cases concerning the Punishment, etc. of Sexual Crimes;
A. The defendant is guilty of the cause for a probation order.
