A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The Defendant is a person who conducts juvenile game providing business with the trade name of “C” in Daegu Metropolitan City Dong-gu B.

No one shall provide game products the contents of which are different from those of the game products rated by the Game Products Management Committee, and no game products related business entity shall promote speculation by providing free gifts, etc. the amount of which exceeds 5,000 won consumer selling price.

그럼에도 불구하고 피고인은 2020. 1. 15.경 집게를 이용하여 게임기 내부에 있는 경품을 집어내는 방법으로 그 경품을 취득하는 일반적인 크레인 게임물로 ‘전체이용가’ 등급을 받은 코코짱, 유니온, 레드스나이퍼, 바버컷알, 골든박스 등 크레인 게임기 30대를 설치하여 놓고, 위 등급분류받은 내용과 달리 별도의 경품지급기를 설치한 후, 위 경품지급기를 열 수 있는 열쇠를 위 크레인 게임기에 넣어 두어 그곳을 찾는 불특정 다수의 손님들이 조이스틱과 버튼을 조작하여 위열쇠를 획득하면 그것으로 위 경품지급기를 열어 그 안에 들어 있는 소비자판매가격 58,500원 상당의 에어로버갤럭시호크드론 등 5,000원을 초과하는 경품을 가져가도록 하였다.
