Defendant shall be punished by a fine of three million won.

Punishment of the crime

1. No game products related business operator who violates matters to be observed by a game products related business operator shall encourage speculation by allowing him/her to gamble or perform other speculative acts by using the game products or by providing free gifts (not exceeding 5,000 won in the consumer sale price);

그럼에도 불구하고 피고인은 2016. 9. 6.경부터 2019. 9. 25.경까지 게임물관리위원회로부터 등급분류를 받은 토이즈팝(TOYS POP, CC-NA-170315-008) 24대, 와이드 러브푸쉬(WIDE LOVE PUSH, CC-NA-170426-013) 2대, BARBERCUT R (바버컷 알, CC-NA-170222-001) 1대, Smile Story2(스마일 스토리2, CC-NA-161123-003) 1대, 조아조아 윷놀이(CC-NA-140710-001) 1대 등 총 29대를 설치해놓고 인천 부평구 B건물 1층 C호에서 ‘D’를 운영하던 중, 2019. 8. 말경부터 다수의 게임기와 보관함에 소비자 판매가격 5,000원을 초과하는 겨울왕국 안나 피규어(34,000원 상당), 원피스 나미 피규어(23,000원 상당) 등의 경품을 비치하여 경품 지급기준을 위반하였다.
