그럼에도 피고인은 2013. 4. 3.경부터 2013. 5. 9.경까지 위 ‘C’ 게임장에서, 게임물등급위원회로부터 게임 자동진행 기능이 없고, 이용자의 조작 및 실력 없이는 아이템카드의 획득이 불가능하며, 3단계 이상을 통과할 경우에만 최종적으로 아이템카드 1장이 나오도록 등급분류를 받은 SUPIYA 3(수피아 3) 게임기 40대에 대해, 버튼자동누름장치인 일명 ‘똑딱이’를 설치하여 게임이용자의 조작능력과는 상관없이 자동으로 위 게임이 진행되도록 하고, 위 게임을 통해 1단계는 아이템카드 1장, 2단계는 아이템카드 3장, 3단계는 아이템카드 5장, 4단계는 아이템카드 10장, 5단계는 아이템카드 50 내지 100장 배출되는 등 각 단계에 따라 최소 1장에서 최대 100장의 아이템카드가 배출되도록 일명 ‘영업버전’으로 위 게임내용을 변조한 후, 위 게임장을 이용하는 불특정 손님들로 하여금 위 게임물을 이용하도록 제공하고, 손님들이 그 게임 결과에 따라 아이템카드를 획득하도록 하였다.
