A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The defendant is a person who works as a management director for a corporation E in Gwangjin-si D.

1. The supply to the Ulsan National Institute of Fire-Fighting, Inc.;

A. A. On April 15, 2009, E Co., Ltd. entered into a purchase contract with the Ulsan Puct BNR headquarters (Duct BNIP). In such a case, according to the above contract, the chemical ingredients, mechanical properties, etc. of the goods must be supplied in compliance with the specifications specified in the contract, etc., and the results should be requested to a certified testing institution to conduct a test at the time of delivery to submit it to the above chemical power plant.

On May 4, 2009, the Defendant requested performance and quality tests on steel samples used in the “Duct BNR Nozle” part to be supplied pursuant to the purchase contract entered into by the U.S. and the U.S. company E with the U.S., the Defendant had been notified of the results of the examination that chemical ingredients fall short of the standard specifications. As such, the Defendant attempted to deliver the said products by forging the test report.

Around May 4, 2009, the Defendant, at his office, arbitrarily stored the test report submitted by the Seoul Southernnam Local Small and Medium Enterprise Office using his own computer, stored the picture file, and then printed out the “Cr” out of the chemical ingredients of the original test report using the Korean picture board program as “13.24%” which is lower than the “14.24%”.

Accordingly, for the purpose of exercising authority, the Defendant forged one copy of the test report under the name of the Administrator of the Small and Medium Business Administration of Gwangju-nam District Office.

B. On May 4, 2009, the Defendant’s uttering of forged official document delivered “Duct BNR Nozle (TIP)” to the staff in charge of the second unit of the above headquarters at the Ulsan Power Center Co., Ltd., the Republic of Korea East-gu, Ulsan-gu, Ulsan-gu.
