A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. The Government shall not photograph the body of another person, which is likely to cause a sexual humiliation or sense of shame, by using mechanical devices having similar functions, such as cameras, etc. in violation of the Act on Special Cases concerning the Punishment, etc. of Sexual Crimes, or distribute, sell, lease, provide, or openly display the photographs thereof against the will;

A. On October 19:30 of 2013, the Defendant: (a) taken a sexual intercourse with the victim C (the 42-year old-old) at a place where it is unknown; (b) taken a photograph of the victim’s body with the victim’s consent to do so; and (c) taken the victim’s body photograph with the victim’s consent to do so; and (d) taken the victim’s body photograph, such as the victim’s failure to contact the Defendant; and (e) taken the victim’s body photograph and sexually related video printed materials on the victim’s batch E during Jeju-si on October 2015, the victim was found to have been displayed openly against the victim’s will in a manner that two persons, who are the victim and two persons of the victim, were seated with a tables.

B. On the same day from around 20:00 to around 21:00, the victim was found in the “singing practice place” located in F, operated by a person who was affiliated with the victim, and had the victim’s photo and sexually related video printed materials 17 pages.

G distributed it against the victim's will in a way that sees it to G and see it.

2. Intimidation;
