Punishment of the crime

1. On March 2017, Defendant A received approximately KRW 620,000 from the Seoul Metropolitan Government as a new bank account (F) in the name of the above childcare center in the manner of registration as if he/she had worked as an assistant teacher of the above childcare center, including that he/she received approximately KRW 620,000 from the Seoul Metropolitan Government as a subsidy for childcare center in the name of the above childcare center in the manner of registration as if he/she had worked as an assistant teacher of the above childcare center. From that time to May 2019, Defendant A received KRW 58,000,000 in total of subsidies by false application or other unlawful means, such as in the list of crimes in the attached Table.

2. Defendant B, as the head of the above child care center, is a person who operates the above child care center jointly with Defendant A, and even though Defendant A was obligated to prevent false applications for subsidies, Defendant A, from March 2017 to May 2019, with a view to helping the person who does not work in the above child care center as described in paragraph (1) by unlawful means, such as registering the person who does not work in the above child care center as an assistant teacher, etc. in the child care integrated information system, and thereby helping Defendant A receive a total of KRW 58 million from Songpa-gu office, with the knowledge that he/she would be able to do so, thereby facilitating the Defendant A’s crime under Paragraph (1) by entrusting the custody of an authorized certificate that can connect to the integrated child care information system.
