1. The plaintiffs' claims are dismissed.

1. Basic facts

A. The five-lane roads in front of the crossing of the above national defense graduate school are exclusive lanes for left-hand and U-turned vehicles, and the two-lanes are straight-on lanes, and the two-lanes pass along the intersection by straight-line, depending on one-lane width, and the two-lanes are installed on the left-hand side of the width.

다. 사고직후 위 스타렉스는 그 좌전방부분이 위 중앙분리대 가드레일의 시작부분과 정면으로 충돌하여 엔진룸 안쪽부분까지 밀려 들어가 크게 파손되었고, 그 후미부분이 뒤편에서 진행하던 소외 I 운전의 J 카니발 승합차(이하 ‘카니발‘이라 한다)가 추돌하여 그 아래쪽 부분이 들어 올려진 모양으로 손상된 채 약 10시 30분 방향으로 1차로에서 정지한 상태로, 위 가드레일 끝부분은 그 충격으로 인하여 사고차량 진행기준 좌측으로 휜 상태로, 카니발은 스타렉스의 후미부분과 조금 떨어져서 그 좌측모서리부분과 좌측휀다부분이 손상된 채 진행방향 기준으로 약 12시 30분 방향으로 1차선과 2차선의 경계차선을 걸쳐 정지한 상태로 각 발견되었다. 라.
