피고인은 2013. 12. 23. 14:25경 안양시 동안구 관양동에 있는 인덕원역 4호선 지하철 8호차 3번 출입문 부근에서 B 등 약 50명의 사람들이 있는 자리에서, 112 신고를 받고 현장에 출동한 피해자 만안경찰서 C지구대 소속 경사 D으로부터 지하철에서 소란을 피운 경위에 대해서 질문을 받자 화가 나 “야! 병신 같은 놈아! 내가 뭘 잘못 했는데 그러냐 씨발 놈아! 좆같은 새끼야!”라는 등 큰 소리로 욕설을 하여 공연히 피해자를 모욕하였다.
