Defendant
A shall be punished by a fine of KRW 500,00, and by a fine of KRW 1,500,000, respectively.
The above fine is imposed against the Defendants.
Reasons
Punishment of the crime
1. No person who violates the Assembly and Demonstration Act in relation to Defendant B’s assembly on October 28, 201 shall hold any outdoor assembly or demonstration at a place within one hundred meters from the boundary of the National Assembly’s office building.
From around 14:25 on October 28, 201, the Defendant organized the Korea-U.S. Free Trade Organization Korea (hereinafter “Korea-U.S. Free Trade Organization Headquarters”) in the front of the Korea-U.S. Industrial Bank (hereinafter “Korea-U.S. Free Trade Organization”), and attended an assembly with approximately 2,500 persons held in the society of the Secretary General of the C organization D. On the same day, at around 14:40 on the same day, the Defendant’s and the D Secretariat of the Korea-U.S. C organization did not have originally reported as a broadcasting vehicle, and inciting the passage of the National Assembly, approximately 2,50 persons and approximately 2,50 persons and more of the Defendant’s and the D Secretariat moved to a four-lane-lane road in front of the Hando-dong Cultural Mar. 25, 201, in a way that they moved to a 1km distance from the place of the first assembly to the nearest 20m of the National Assembly, and inciting the participants from the two to the front of the Korea-U.
Accordingly, the defendant participated in an outdoor assembly or demonstration at a place within 100 meters from the boundary of the National Assembly building, which is the place where the assembly or demonstration is prohibited.
B. On October 28, 201, the Defendant had ordinary traffic obstruction from around 15:20 to 15:30.
In common with approximately 2,50 demonstration units, the two-lanes of the two-lanes of the two-lanes between the northwest of the National Assembly and the East East of the National Assembly were completely occupied by about 10 minutes, thereby hindering the traffic of roads used for the traffic of the general public.
