1. The plaintiff

A. Defendant C’s share in 4/22 of shares in respect of 595/79 of the real estate listed in [Attachment List No. 3].

1. Basic facts

A. Each real estate listed in the separate sheet (hereinafter referred to as the “each real estate of this case”) was owned by the original network E.

B. As the deceased died on March 6, 1975, the F, South Korea, Defendant D, the plaintiff, G and H, who is his spouse, G and H, who is his father, and I and J have jointly inherited the deceased's property. The shares of inheritance under the Civil Act at the time of the death are as follows:

-F : 2/22 - Defendant D: 6/22 - Defendant B, Plaintiff, respectively 4/22- G, and H: 1/22-I/J respectively. 22/22

C. When the deceased died as above, the defendant D assumes documents as if the deceased purchased each of the instant real estate from the deceased, and on March 15, 1975, the order 1-C on March 12, 1975 as to each of the instant real estate was made on the ground of the sale on March 12, 1975.

Each registration of ownership transfer entered in the subsection is completed.

Defendant D, on March 22, 1990, ordered the sale of each of the instant real estate to Defendant B on March 12, 1990, by reason of the sale as of March 12, 1990.

Each registration of ownership transfer entered in the port was made.

E. On May 19, 198, Defendant B made an order with respect to the portion of 595/799 shares in the real estate listed in paragraph (3) of the attached Table No. 3 (hereinafter referred to as “third real estate”) to Defendant C as of May 19, 1998 on May 11, 1998.

The transfer registration of ownership in the subsection was made.

2. Determination as to Defendant B and C’s main defense

A. As to the lawsuit of this case seeking the implementation of each of the cancellation registration procedures, the plaintiff asserted that the registration of ownership transfer made in the name of defendant D with respect to each of the instant real estate was null and void because it was made without any cause, and that the registration of ownership transfer made in the name of defendant B and the registration of ownership transfer in the name of defendant C are null and void.
