Punishment of the crime
[2013 Highest 5914] In the course of the actual operation of C Company, the Defendant purchased the said D land from G, and constructed the 3rd operation (8th operation) and 8th operation (8th operation) of I Building after purchasing the said F land from H, and purchasing the said F land from H, to G for the third operation of the said D, E, and I Building, and to H for the third operation of the said F land and I Building, the Defendant completed the registration of 1/2 shares for the said F land and I Building, and the registration was completed in the name of J, the Defendant’s wife for the third operation of the said F land and I Building.
1. Forgery of private documents;
A. On October 5, 2012, the Defendant, at the L Licensed Real Estate Agent Office located in Nam-gu Incheon Metropolitan City, sold to M the third Na Dong 302, 15 million won of the I building, without authority, forged a copy of the real estate sales contract under the name of H, which is a private document concerning rights and obligations, by arbitrarily recording his/her personal information in the seller’s column, and affixing his/her seal thereto, without authority.
B. On December 20, 2012, the Defendant: (a) around December 20, 2012, at the O Licensed Real Estate Agent’s Office located in the Nam-gu Incheon Metropolitan City N, leased KRW 401 to P with deposit 25 million; (b) arbitrarily recorded the personal information of G, a joint equity right holder, in the column of the lease agreement without authority; (c) sealed the seal of G; and (d) forged one copy of the real estate lease agreement in the name of G, a private document on rights and obligations.
C. On January 7, 2013, the Defendant: (a) written confirmation to the effect that, at the office of the second 101 office of the 101st office of the 1st office of the 1st office of the 1st office of the 1st office of the 2nd office of the 2nd office of the 201st office of the building, the Defendant reversed the sales contract for the 302nd office of the 1st office of the 3nd office of the 1st office of the 201st office of the building, and that M would pay the 50 million won in total and 15 million won in total
