A defendant shall be punished by imprisonment for not less than one year and six months.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. On July 24, 2019, the Defendant violated the Road Traffic Act and the Road Traffic Act (driving without a license) and received a summary order of KRW 3 million from the Changwon District Court as a crime of violating the Road Traffic Act (driving without a license).

On September 17, 2019, from around 02:20 to around 02:45 on the same day, the Defendant driven a F rocketing car under the influence of alcohol content of about 0.157% without obtaining a driver’s license from the front side of convenience stores in Jinju-si to the front side of E located in D at the same time.

As a result, the defendant driving a motor vehicle without obtaining a driver's license, and at the same time violated the regulations on prohibition of drinking at least twice.

2. On September 17, 2019, the Defendant violated the Road Traffic Act: (a) while under the influence of alcohol around 02:20 on September 17, 2019; (b) while driving a F rocketing car on the road before the point of convenience set forth in paragraph (1) above, the Defendant set up the said car on the road front of G at the time of Jinnam-si, while driving it on the road.

At around 02:42 on the same day, the police officer, who received a report and called out at the same place, demanded the defendant to leave the vehicle of the defendant by leaving the window of the driver's seat and leaving the vehicle of the defendant, and the fact of drinking and driving without a license should be discovered, and the defendant started driving and driving without a license with the intention to escape.
