Reasons
Punishment of the crime
1. The Defendants’ co-principal
A. On November 5, 2018, around 00:42, the Defendants discovered the D typ typ typ-to-be parked in the public parking lot located in Jinju-si, 73-1, and Defendant A reported the network around the victim, Defendant B opened the front door of the vehicle, and entered the vehicle into the vehicle and stolen BM X5 passenger cars owned by the victim.
As a result, the defendants stolen the victim's property together.
B. On November 5, 2018, around 01:16, the Defendants discovered FMW X5 car in an amount equivalent to approximately KRW 90,000,000 for the market price owned by the victim C, parked at the E parking lot at Jinju-si, and Defendant B removed the correction device for the said car by using a stolen smart key as described in the foregoing paragraph (a), and Defendant B was on board the front line, and Defendant A was on board the driver’s seat and driven the said car.
Accordingly, the defendants stolen the victim's property jointly.
2. Defendant A
A. On November 5, 2018, the Defendant violated the Road Traffic Act (free license) without obtaining a driver’s license. Around 01:30 on November 5, 2018, the Defendant driving a FMW X5 car at approximately 20km section from the E parking lot in Jin-si to the road of the same Si superior-dong, the first-dong, the first-dong, the opposite Dong, and the front side of the house, as described in paragraph (1). Around 21:00 on the same day, the Defendant used the said BMW X5 car at approximately 200km section from the front of Jin-si, Jin-si to the front of Jin-si, the same Sin-si, the first-dong, the Changwon-si, and the Daegu City Council.
B. Violation of the Act on Special Cases Concerning the Settlement of Traffic Accidents (Bodily Injury) is a person who is engaged in driving a FMW X5 car.
At around 03:00 on November 5, 2018, the Defendant: (a) parked the said car in front of the J apartment door, Jaju-si, in order to get off the car while driving the car with the victim H (W, 15 years of age) and I, etc. after leaving the said car.
