Defendant shall be punished by imprisonment for a term of one year and four months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. Violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (Bodily Injury resulting from Dangerous Driving) is a person engaged in driving automobiles B.

On March 1, 2020, the Defendant driven the said car under the influence of alcohol level of 0.161% on blood alcohol level around 20:40, and led the Defendant to drive the said car in accordance with the two-lanes of the 665-lane 1, Mapo-gu, Seoul, Sungsan-dong 665, Sungsan-dong, Seoul, along the direction of the shooting range in the C market.

Since the EMW320D car driven by the victim D (the age of 27) was stopped in the signal atmosphere, the driver had a duty of care to accurately operate the steering and brake system and to safely proceed by adjusting the speed in advance.

Nevertheless, while under the influence of alcohol, the Defendant neglected to do so, and was negligent in driving the vehicle of the victim who was in the atmosphere of the signal at the front of the road. The Defendant followed the victim’s vehicle in the front of the vehicle operated by the Defendant.

As a result, the Defendant suffered injury to the above victim by negligence in the course of performing his duties, such as an inception which requires approximately two weeks of medical treatment, in a state where normal driving is difficult due to influence of drinking.

2. On November 21, 201, the Defendant issued a summary order of a fine of two million won for a crime of violating the Road Traffic Act at a height support by the District Court of the Republic of Korea on November 21, 201.

The Defendant driven a B lus vehicle under the influence of alcohol level of about 0.161% in the section of approximately 6 km from the 6km-dong, Mapo-gu, Seoul Metropolitan Government to the front road of the 665 World Cup Stak Stak Stak Stak Stak-dong, Mapo-gu, Seoul, the date and time indicated in paragraph (1) above.

As a result, the Defendant violated the regulations on the prohibition of drunk driving more than twice.
