1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Basic facts
A. On November 11, 2009, the Plaintiff filed a lawsuit to claim the return of lease deposit against the head of Suwon District Court 2009Kahap7959 (hereinafter referred to as the “YY market”) with the head of the PY market (hereinafter referred to as the “PS market”), and on November 11, 2009, the head of the PY market (hereinafter referred to as the “instant judgment”) was sentenced to the judgment that the Plaintiff would pay 5% per annum from July 2, 2009 to November 11, 2009 with the amount of KRW 100,000 among the above and the above amount of KRW 100,000,000 to the Plaintiff, and the amount of KRW 20% per annum from the next day to the date of full payment (hereinafter referred to as the “instant judgment”). The above judgment became final and conclusive as it is with the intention of the appeal period.
B. In the procedure of compulsory auction (hereinafter “instant compulsory auction”), the Defendant (formerly, the “Co-ownership”) purchased the relevant co-ownership listed in the table below, which is the ownership of the camping market, from among each partitioned buildings listed in the separate sheet (hereinafter “instant partitioned building”) as part of the instant building, and completed the registration of ownership transfer on December 22, 2008.
The defendant thereafter from February 2009 to March 201, 2010 to the other co-owners of this case.
