A defendant shall be punished by imprisonment for one year.

The defendant pays 70 million won to the applicant for compensation by fraud.

3.2

Punishment of the crime

1. Frauding the victim C, forging private documents, or uttering of falsified investigative documents against the victim C;

A. On September 27, 2010, the Defendant: (a) should pay the remainder of KRW 70 million to Hyundai Industrial Development Co., Ltd. in order to transfer ownership registration under the name of the Defendant 2-dong 308, a D building D that had resided without transferring its registration; (b) to cover the said money from another person; and (c) was introduced by E-real estate brokers who arranged the said apartment sale contract.

Since the Defendant borrowed KRW 70 million from C to prove the Defendant’s financial ability to repay, the Defendant had been trying to forge the above store lease agreement in order to show that the right of lease of the panty store F, which was over the period of operation of the Defendant, still exists to the Defendant.

On March 29, 2013, the Defendant, in F in the real estate lease contract form No. 140 of the Busan metropolitan GG building No. 140 of the Busan metropolitan G building, stated “140 of the Busan metropolitan G building G building No. 140”, “l million won (70,000,000), “l million won (19,000)” in the column of the deposit, “l million won (3301, 114, 301, 1, and 114, 304, and 104, and 1’s prior seal was affixed to the lessor’s name.”

Accordingly, for the purpose of exercising, the Defendant forged one copy of the real estate lease agreement in the name of I, a private document on rights and obligations.

B. On March 29, 2013, the Defendant, at the E-real estate office located in the Busan metropolitan Daegu K, exercised a forged real estate lease contract as if it were a document that was duly formed.

C. The Defendant is the victim at the E-real estate office on March 29, 2013.
