The judgment below

In light of the records, the court below reversed the judgment of the court of first instance which found the defendant guilty on the charge of special assault among the facts charged of this case, and found the defendant not guilty on the ground that there is no proof of facts constituting a crime, and there is no violation of law of logic and experience and free evaluation of evidence without sufficient deliberation as alleged in the grounds of appeal.

On the other hand, the prosecutor appealed against the guilty portion of the judgment below, but the notice of appeal or the appellate brief does not indicate the grounds for objection to this part.

Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
