A A shall be punished by a fine of 2.5 million won, and Defendant B shall be punished by a fine of 1.5 million won.

The above fines are imposed by the Defendants.

Punishment of the crime

1. A person running a business affecting public morals in violation of the Act on the Regulation of Amusement Businesses Affecting Public Morals (including any person who does not obtain permission, authorization, make a registration, or make a report) shall not allow, arrange, or provide any obscene act at a public morals business place. However, the Defendants operated a so-called “E” in the name of “E” on September 30, 2014 from around October 17, 2014 to around D4 of the same year by jointly operating the so-called “E”. The Defendants received money from the said F, G as a female employee by having the said F, “F,” and “E,” in the name of “E”, “E” from around 17, 2014 to around 17, 2014.

As a result, the Defendants conspired to commit obscene acts at a public morals and place of business.

2. 청소년보호법위반 누구든지 청소년유해매체물로서 상업적 광고선전물을 청소년의 접근을 제한하는 기능이 없는 컴퓨터통신을 통하여 설치부착 또는 배포하여서는 아니 됨에도 불구하고, 피고인들은 2014. 9. 30.경부터 같은 해 10. 17.경까지 서울 시내 일원에서 누구든지 게시물을 볼 수 있는 인터넷 ‘H’ 사이트(H)에 서울 중랑구 D 4층 소재 피고인들 공동 운영의 ‘E’ 키스방에 관한 인터넷 광고를 의뢰함으로써, 위 사이트에 “E. 잘빠진 몸매에 여성스러우면서도 단아한 외모!!, 이쁜외모에 뽀얀피부!!, 30분-4만 원, 60분-7만5천 원, 예약문의 I, 중랑역4번 출구에서 내리면 자세히 설명해 드리겠습니다”라는 등의...
