A defendant shall be punished by imprisonment for one year.

Punishment of the crime

On March 26, 2015, the Defendant was sentenced to three years and six months of imprisonment with prison labor for the crime of extortion in Suwon District Court Pyeongtaek District Court on March 26, 2015. On June 9, 2016, the Defendant was sentenced to four months of imprisonment with prison labor for a violation of the Punishment of Violences, etc. Act (joint injury) in the sexual support branch of the Daegu District Court on March 27, 2018 and completed the execution of the said sentence in the Daegu Prison on March 27, 2018. On July 25, 2019, the Defendant was sentenced to five years of imprisonment with prison labor for the violation of the Act on the Aggravated Punishment, etc. of Specific Economic Crimes (Fraud) in the Seocho District Court

On August 29, 2018, the Defendant made a statement to the effect that “The Defendant would pay a rental fee to the victim for a rental of construction equipment necessary for the construction site and return it after one month,” from the RR Co., Ltd. in the Operation of the Victim EH in Ansan-si.

However, the fact was that the defendant was planning to dispose of the construction equipment borrowed from the victim in another place, and there was no intention or ability to return it to the victim.

On August 29, 2018, the Defendant received from the victim the amount of KRW 30 million from the “EJ” parking lot located in the “EJ” population EI, and then acquired the amount of KRW 350 million from September 6, 2018, by transfer of KRW 7,500,000 of the market price and two parts of the equipment related to the drilling (clers and slabs) as shown in the attached list of crimes.
