A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

No person shall arrange the lending of a national technical qualification certificate.

Nevertheless, the Defendant arranged the lending of a national technical qualification certificate between an enterprise that requires a national technical qualification certificate and a national technical qualification certificate holder in order to meet the standard requirements required by the relevant laws and regulations, and paid a pre-determined rental fee to the lender of the certificate at the price of the business, and thought to be acquired by himself.

Accordingly, on November 1, 2017, the Defendant sent D national technical qualification certificates to D in the Defendant’s residence located in Seo-gu Incheon, Seo-gu, Incheon. The Defendant: (a) contacted D, who posted comments related to job-seeking on the C Association’s website, to the effect that “to lend national technical qualification certificates; (b) obtained the above D’s license as a fire-fighting equipment engineer (technical field) and a fire-fighting equipment engineer (electric field) and sent it to E at the king-si; and (c) assisted the F to obtain a lending of D national technical qualification certificates from December 1, 2017 to September 30, 2018; and (d) provided D with KRW 11,50,000 from F in return, paid KRW 3,70,000 among them as a loan fee.

In addition, the Defendant arranged the lending of national technical qualification certificates over a total of 148 times from August 1, 2014 to May 20, 2019 by the same method, as indicated in the attached list of crimes.
