1. The plaintiff's ground of appeal citing the judgment of the court of first instance is not significantly different from the plaintiff's conjunctive assertion in the court of first instance, and the fact-finding and decision of the court of first instance are justifiable even if the evidence submitted to the court of first instance was presented to this court.
