1. The Defendant’s KRW 78,703,90 for the Plaintiff and 15% per annum from April 4, 2019 to May 31, 2019, and the following.

The judgment on the cause of the claim was made by the Plaintiff from June 5, 2018 to January 16, 2019, with respect to assembly, replacement, repair works, etc. of various machinery, and the Defendant, as above, failed to pay the construction cost equivalent to KRW 78,703,90 as of the Plaintiff even when the Plaintiff made an assembly, replacement, repair works, etc. of various machinery, and the fact that the Plaintiff did not dispute between the parties, or that the construction cost equivalent to KRW 78,703,90 as of the date of payment was not paid, can be acknowledged by comprehensively taking into account the purport of the entire pleadings as set forth in the items of evidence A No. 1 to 4.

(1) The Defendant is obligated to pay to the Plaintiff damages for delay calculated at the annual rate of 12% per annum under the former Act on Special Cases Concerning the Promotion, etc. of Legal Proceedings (amended by Presidential Decree No. 29768, May 21, 2019) from April 4, 2019 to May 31, 2019, the Defendant is obligated to pay to the Plaintiff damages for delay calculated at the rate of 15% per annum under the former Act on Special Cases Concerning the Promotion, etc. of Legal Proceedings (amended by Presidential Decree No. 29768, May 21, 2019); and from the next day to the date of full payment, the damages for delay calculated at the rate of 12% per annum under the Act on Special Cases Concerning the Promotion, etc. of Legal Proceedings, etc., from the next day to the date of full payment.

[Plaintiff claimed for the payment of damages for delay calculated at the rate of 15% per annum from April 4, 2019, following the delivery date of the original copy of the instant payment order, with respect to KRW 78,703,90 for the said unpaid construction cost. However, the statutory interest rate under the Act on Special Cases Concerning Expedition, etc. of Legal Proceedings (Presidential Decree No. 29768, Jun. 1, 2019) was changed to 12% per annum from June 1, 2019, since the statutory interest rate under the Act on Special Cases Concerning Expedition, etc. of Legal Proceedings was changed to 78,703,90 won due to the said payment order, following the delivery date of the original copy of the instant payment order from April 4, 2019 to May 31, 2019.
