The Plaintiff seeking payment of damages for delay calculated at the rate of 15% per annum from July 18, 2019, following the date of service of the original copy of the instant payment order with respect to the unpaid construction cost of KRW 31,712,00,00. However, the Plaintiff’s statutory interest rate under the Act on Special Cases Concerning Expedition, etc. of Legal Proceedings (Presidential Decree No. 29768, Jun. 1, 2019; Enforcement Decree No. 29768, Jun. 1, 2019) was changed to 12% per annum from June 1, 2019, with respect to KRW 31,712,000, following the delivery date of the original copy of the instant payment order, and the Plaintiff’s damages for delay calculated at the rate of interest rate of Article 3(1) of the Act on Special Cases Concerning Expedition, etc. of Legal Proceedings from July 18, 2019 to the date of full payment.
