1. 재물손괴 피고인은 2019. 5. 15. 15:00경 경북 청도군 B에 있는 피해자 C(57세)가 운영하는 ‘D’ 식당에서 피해자의 처인 E(여, 53세)가 평소 자신과 사이가 좋지 않은 F직원들과 피고인의 험담을 한다고 생각하여 술에 취한 상태에서 위험한 물건인 벽돌을 들고 위 식당 안으로 들어가 그곳에 있는 테이블에 벽돌을 집어 던지고 테이블과 의자를 손으로 뒤집어엎은 후, 컵 건조대 등을 집어 던졌으며, 이를 보고 경찰에 신고를 하고 있는 피해자 E을 향해 그곳에 있던 의자들을 던지고, 위 식당을 나가면서 위 식당의 출입문에 설치된 방충망을 발로 찼다.

2. 특수상해 피고인은 위 1항과 같은 일시ㆍ장소에서 위 1항과 같이 소란을 피우던 중, 피해자 E(여, 53세)이 경찰에 신고를 하자, “신고를 해 신고를 ”라면서 그곳 주방에 서있던 피해자를 향해 2회에 걸쳐 식당 내에 있던 위험한 물건인 철제 의자(높이83cm, 넓이36cm)를 집어 던져 그곳 주방에 있는 냉장고에 부딪혀서 튕겨진 의자에 피해자의 좌측 무릎 부위가 부딪히게 함으로써 피해자에게 약 2주간의 치료가 필요한 좌측무릎부위 타박상의 상해를 가하였다.
