1. The plaintiff's claim is dismissed.

1. Details of the disposition;

A. The Plaintiff was appointed as a policeman on December 30, 1987, and was promoted as of March 1, 2009, and served in B police station from February 19, 2009 to February 9, 201, and in Seoul Central Police Station C from February 14, 2013 to June 18, 2013.

B. At the time of working at the above B police station investigation and investigation support team, the Plaintiff received a request from the director of the division and the chief of the division for the national funds necessary for investigation activities, such as criminal reporting compensation, and received the support, and deposited the national funds into the deposit account under the name of the government agency and received the support, and carried out the duties,

C. On November 9, 2012, at the regular audit of the National Police Agency in 2012, it was revealed that, between August 7, 2009 and August 12, 2010, the Plaintiff was working at the investigation support team of the said B police station, the Defendant withdrawn cash without permission from the bank account in the name of the government agency where the criminal reporting compensation, etc. is deposited or transferred to the Plaintiff’s deposit account, and accordingly, the Defendant filed an accusation against the Plaintiff with the Seoul Central District Public Prosecutor’s Office.

A suspect is a police officer belonging to the B police station investigation support team and has been engaged in accounting-related affairs, and he voluntarily withdraws the total of 8.5 million won from the investigation budget management account from August 7, 2009 to August 12, 2010 to 18 times in total, and uses it for personal consumption. On March 29, 2013, the prosecutor of the Seoul Central District Prosecutors' Office suspended the prosecution of the plaintiff on the crime of occupational embezzlement as follows.

From August 7, 2009 to August 12, 2010, the Seoul Central Police Station General Disciplinary Committee for Police Officers of the Seoul Central Police Station has embezzled total of KRW 8.5 million on 18 occasions by withdrawing cash from four deposit accounts (4.7 million in total) where the investigation support team's investigation support team's investigation budget was kept from August 7, 2013 to August 12, 2010, or transferring (14.6.8 million won in total) to the Plaintiff's deposit account.
