A defendant shall be punished by imprisonment for one year.
However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.
Reasons
Criminal facts
1. On January 16, 2017, the Defendant posted a letter to the effect that “a gallon A7 is sold” on the Internet site NAVV and national car page at the PC room located in the sphere of Suwon-si, Suwon-si, Suwon-si, Suwon-si.
However, the defendant did not have intention or ability to sell A7 when the above gallon block.
Nevertheless, the defendant reported and contacted the above notice to the victim C, stating that "on the deposit of the price of the goods, at the above gallon ju, the defendant would send A7 B a lot of gallon." The defendant was transferred KRW 173,000 to the bank account (D) of the defendant's name as the price of the goods on the same day from the victim.
The Defendant was transferred totaling KRW 14,135,90 from July 26, 2016 to February 9, 2017 to the victims totaling KRW 14,135,900, as described in the attached Table 1 list of crimes.
2. On April 13, 2017, the Defendant posted a letter to the effect that “the sale of seals when galloning is galloned” in the sphere E and 101 of the Suwon-si, Suwon-si, the residence of which was located, on April 13, 2017.
However, the defendant did not have intention or ability to sell the above gallonis.
Nevertheless, the defendant stated that "on the deposit of the price of the goods with the victim F who reported and contacted the above notice, the defendant would send the above gallon identification as a door-to-door dispatch," and that he received 80,000 won from the victim to the post office account in the name of the defendant as the price of the goods on the same day.
The Defendant was transferred the sum of KRW 5,111,50 from August 4, 2016 to April 14, 2017 to the victims in total 43 times, as shown in the attached Table 2 List of Crimes.
3. On March 1, 2017, the Defendant posted a letter on the Defendant’s home located in Suwon-si E, Suwon-si, and reported the said letter to the effect that “Sales of Blue PCs” on the Internet NAVV’s website.
