A defendant shall be punished by imprisonment for one year.
The defendant shall obtain money from C who is an applicant for compensation, 380,000 won, and D who is an applicant for compensation.
Reasons
Punishment of the crime
[criminal record] On November 30, 2012, the Defendant sent to the Juvenile Department in Gwangju District Court for fraud, and was discharged from Gwangju Juvenile Center on July 13, 2013.
[2014 Highest 21] On October 3, 2013, the Defendant: (a) written the intent or ability to send Kameras, even if he/she receives the payment of Kameras; and (b) written a false statement to the effect that he/she would send Kameras to the victim F who reported and contacted it; and (c) received 170,000 won from the victim to the agricultural passbook (G) in the name of the Defendant on the same day; and (d) received 170,000 won from the victim until November 19, 2013, and acquired 4,810,000 won in total from the victims through 13 times in total, as shown in the attached Table 1 of Crimes List from November 19, 2013.
[2014dan72] On December 24, 2013, the Defendant: (a) reported on the Internet NAVER’s “NER” around December 20, 2013, but did not have the intent or ability to send a mobile phone even after receiving the mobile phone price, and made a false statement that the Defendant would contact the victim with the victim and send the mobile phone.
On December 25, 2013, the Defendant, by deceiving the victim as above, received 54,500 won from the victim through the Gwangju Bank account (J) in the name of Gwangju Bank on December 25, 2013 and acquired it by money.
[2014 Highest 156] On October 13, 2013, the Defendant made a false statement that he/she would contact the victim K to the effect that he/she would not have any intent or ability to send the uniting machine even if he/she received the uniting machine sales price, and would send the uniting machine by communicating it with the victim K, and that he/she received 70,000 won from the victim and received it from the victim to January 17, 2014, and then received it through 17 times in total, such as the crime list 2.
