A defendant shall be punished by imprisonment for not less than two years and six months.

The defendant shall complete the sexual assault treatment program for 40 hours.

Reasons

Punishment of the crime

The defendant has been living and living together with the victim C (here, 8 years of age) who is his/her father and wife while his/her spouse has married.

1. On March 2013, at around 20:0 to 22:00, the Defendant, while watching television with the victim at the Defendant’s house located in Hongcheon-gun, Hongcheon-gun, the Defendant: (a) called “the important part is so as to have been cut off;” (b) putting the hand into the victim’s inner part to panty panty; (c) kid the sound above the victim; and (d) her resistance, the Defendant laid her chest by putting the hand into the victim’s inner part.” (a) The Defendant she laid her chest by inserting her hand into the victim’s inner part.

Accordingly, the defendant committed an indecent act on the part of the victim who had relatives four times in total.
