A defendant shall be punished by imprisonment for not more than ten months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. The Defendant and the Defendant, B, and C, in mind of obtaining the repair and insurance money of an external agent in a false accident, purchased Dbenz car, and intentionally reported a traffic accident with C introduced from an agent E and B known to the original state, and planned to receive the insurance money from an insurance company.
On August 1, 2013, at around 21:53, the Defendant intentionally received the back portion of the FMW Austria set up in the front part of the passenger car of the Defendant, while driving Korea-U.S. Bank, located in the Gangnam-gu Seoul Metropolitan Government Doro 2, on the front part of the Doro Doro Doro Doro Doro Doro.
B Based on the above intentional traffic accidents, B filed an accident report with the purport that the victim Hyundai Maritime Fire Insurance Co., Ltd. was able to receive the above BMW Or, and around August 6, 2013, B transferred KRW 9,400,000 to the new bank account under the name of B for the unrepair cost, and around August 20, 2013, the victim transferred KRW 9,500,000 to the new bank account under the name of C under the same name as the damage adjustment cost to the victim. On the same day, the victim transferred KRW 300,000 to the new bank account under the name of EMM vehicle damage adjustment.
Accordingly, the defendant, B, and C conspiredd the victim to receive property or obtain property benefits equivalent to the above damage assessment costs.
2. On November 28, 2013, the Defendant’s sole criminal administration decided to receive insurance money by intentionally taking advantage of the fact that the Defendant intentionally purchased an accident at a breakwater located in the long-term coast guard, i.e., a designated driver’s agreement to which the insurance is applicable, at the breakwater located in the high-nam-gun, Gosung-gun, Chungcheongnam-gun. On November 28, 2013, the Defendant went back to the sea while driving the said bents car.
The Defendant is a victim on the ground of the above intentional traffic accident.
