A defendant shall be punished by imprisonment for not less than one year and six months.
However, the execution of the above punishment shall be suspended for three years from the date this judgment became final and conclusive.
Reasons
Criminal facts
1. On September 19, 200, the Defendant violated the Punishment of Violences, etc. Act (Habitual Assault) stated that the Defendant ordered drinking at the “Finginging-up 50 years of age” operated by the victim E (hereinafter “Fing-gu, Bupyeong-gu, Incheon) on September 19, 200, and asked the victim to sing for three hours at the “Fing-gu, Bupyeong-gu, Incheon (hereinafter “Fing-gu, 50 years of age).” On the same day, the Defendant asked the victim to pay for singing, etc. at around 22:00 on the same day, “I want to pay money, if I want to do so, or if I will report to the police, I will know how I will do it?” The victim asked the victim “ will pay money if I want not receive a report on the need to do so.”
The Defendant had the victim of frighten drinking, 60,00 won, 60,000 won, and 135,000 won in total, and 135,000 won in each of the five diseases in beer, and received the pecuniary benefit equivalent to the same amount, and received the additional amount of KRW 20,000 in tin.
In addition, from that time until November 1, 2014, the Defendant habitually 12 times during a total of 1,056,000 won, and received a total of 1,05,000 won, such as the list of crimes (1) in attached Form 1, and attempted to receive a total of 798,000 won by threatening the victims four times in total. However, the Defendant did not commit an attempted crime.
2. On November 6, 201, the Defendant interfered with business: (a) at around 21:00, the Defendant refused the victim H (the age of 45)’s “I singing practice room” in the operation of Bupyeong-gu Incheon Bupyeong-gu, Incheon, for the reason that the victim was refusing the victim’s “recepting the helper”; (b) opened a room in which the instant singing practice room customers are singing, and reported to the police to the effect that the said singing practice room customers had sing their singing, and then arranged female customers to sing down their photographs.
