1. The Plaintiff, Defendant A, Defendant A, and Defendant B, as well as each of the said money, KRW 21,000,000 and each of the said money from August 31, 2013 to April 2015.
Reasons
1. Basic facts
A. Defendant A, on April 30, 2013, 23:06 on the frontway located in Ansan-si C, with alcohol together, went beyond the two hands while Defendant B was drinking together with E.
B. While under the influence of alcohol content 0.133%, G, which operated the F Freight Vehicle (the Cargo Vehicle) and passed the said road, did not discover E going beyond the road, and caused a traffic accident (the instant accident) resulting in the death of an external cerebral cerebral cerebral typosis due to E, by flying away with the front wheels part of the instant freight vehicle, without discovering E going beyond the road.
C. On August 30, 2013, the Plaintiff paid KRW 210,000,000 to E’s inheritors, as an insurer who entered into a comprehensive automobile insurance contract with G on the instant cargo vehicle.
2. Determination of the parties' arguments
A. The plaintiff asserts that G's negligence and the Defendants' negligence going beyond the road caused the accident of this case. The plaintiff paid insurance money to the plaintiff, and the defendants were exempted from the amount of negligence (the defendant A 30% and the defendant B 20%). Accordingly, the defendant A asserts to the purport that the defendant A did not have the negligence of the defendant A since he escaped without taking relief measures after he was over the E, and the defendant A went away without taking relief measures.
B. The above basic facts and various circumstances revealed in the argument of the instant case, namely, the point of the instant accident, even if it is sufficiently foreseeable that the traffic accident may occur if the point of the instant accident is pushed ahead to the road along one lane, Defendant A went beyond the road, Defendant B provided a stop for Defendant A to t to go beyond the road, and Defendant B provided a stop of the instant accident while driving under the influence of alcohol at night. G caused the instant accident while driving under the influence of alcohol at night. If the road of the instant accident is one lane, and G was under the influence of the road, under the name of neighboring commercial buildings and street, etc., the instant accident can be prevented.
