A defendant shall be punished by imprisonment for not less than two years and six months.

However, the execution of the above punishment shall be suspended for five years from the date this judgment becomes final and conclusive.

[Judgment of the court below] The defendant is a foreigner of Kazakhistan nationality, and a person who illegally stays in the Republic of Korea after the lapse of the period of stay on June 9, 2018, is not a person handling narcotics.
