A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The organization of telephone financial fraud (one-time “Scaming”) is divided into two roles: “total liability” in charge of organic communications between the organization’s internal point organizations in China; “cambling money to a designated account by misrepresenting the investigative agency, financial institution, etc. to a large number of unspecified people within the Republic of Korea; “cambling staff of the call center” in which the victims transfer money to a designated account; “cambing” in receipt of the account to be used for committing the scaming from the account holder; “scambling” in case of remitting money to the designated account; “scambling” in which the victims withdraw the source of damage; “delivery” in direct withdrawal of the amount of damage from the recruitment book; “cambling” in which the victims directly withdraw or deliver the amount of damage to the designated account; and “collections” in which the victims deposited money to the designated account.

The name in the instant case is a person who operates, transfers, withdraws, or prohibits the receipt of a call center as a member of the Bosing Organization, and the Defendant received contact from the victim and received the injury from the victim, and again received it from the victim, and performs the crime by sharing the organic role as a collection measure to deposit it in the one-person passbook, etc.

On December 2, 2018, the Defendant received the letter of intent to borrow a low interest rate loan from a mobile phone from the Seocho-si in order to contact with the Defendant, and came to know of the above singishing singing employee (one proxy) in his name, and accepted the proposal that “In order to obtain a low interest rate, the details of the passbook transaction need to be provided, and the Defendant will make the loan by means of withdrawing the money from the Defendant’s passbook and depositing it into the bank account designated by him,” and then, accepted it in accordance with the instructions of the above singulars.
