A defendant shall be punished by imprisonment for not less than one year and six months.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

Reasons

Punishment of the crime

[2015Kadan98] The Defendant reported that many people intend to purchase goods, such as mobile phones, through a "number of lots," which is a transaction site of used goods on the Internet, and attempted to contact the said persons as if the Defendant sold the goods, and to acquire money from those who belong thereto.

On November 21, 2014, the Defendant: (a) connected to a gallon system using a mobile phone in the Defendant’s name; (b) reported the victim C’s attempt to purchase a gallon mobile phone; (c) notified the victim of the Nogallon’s account number in the name of D; and (d) received KRW 110,000 from the victim on November 21, 2014, by falsely concluding that “10,000 won is remitted to the agricultural bank account in the name of D.”); and (c) received KRW 110,000 from the victim.

As a result, the Defendant, by deceiving the victim, received 110,000 won from the victim and acquired it, and acquired 5,094,000 won in total over 33 times, such as the statement in the crime list, from July 14, 2014 to February 12, 2015.

[205] On December 20, 2014, the Defendant posted a false letter to sell a cell phone in the “number of lots”, a transaction site of used goods via the Internet, and acquired KRW 60,000 from the victim E to the Agricultural Cooperative (Account Number: G) account in the name of F, and acquired KRW 150,000 in total, by transfer from the Agricultural Cooperative (Account Number: I) account in the name of H to KRW 90,000.
