1. Facts of recognition;

가. 피고는 2013. 9. 9. 00:00경 페이스북을 통하여 알게 된 만 14세의 청소년인 원고 A과 서울 송파구 방이2동에 있는 방이공원에서 만나, 원고 A을 벤치에 앉힌 뒤 어깨를 자신의 손으로 눌러 반항하지 못하도록 한 후 원고 A에게 키스하고, 위 원고가 반항하자 “쌍년이 짜증나게 한다, 빡친다”라고 욕을 하면서 때리려는 시늉을 하는 방법으로 원고 A을 협박하여 반항을 억압한 후, 손으로 A의 가슴을 주무르고 음부를 만지고, 원고 A으로 하여금 피고의 성기를 만지게 하였다.

B. 2. Determination

A. According to the facts acknowledged above, the defendant's act of indecent act against the plaintiff A constitutes a tort against the plaintiff, and thus, the defendant is liable for compensating the damage suffered by the plaintiffs due to the defendant's tort.

B. 1) Plaintiff A’s property damage Nos. 2-4 (including household numbers), according to each description, Plaintiff A diagnosed two times, including the instant tort, on October 1, 2013 and April 2014, following the instant tort.
