The defendant shall be innocent.

1. On September 22, 2015, the summary of the facts charged: (a) 58 organizations, such as the Federation of the Korean Democratic Workers’ Unions, the Federation of Farmers’s Federation, the Federation of the Korean People’s Unions, the Association of the People’s Republic of Korea, and the Sports Collaboration, decided to integrate each assembly on the basis of various major government issues, such as labor reform, history textbooks, and rice price decline; and (b) upon the launch of “the headquarters for the studs of the studs of the public and the Seoul Republic of Korea,” “the head of the headquarters for the studs of the studs of the public and the people’s studs of the studs of the 14 November 14, 2015, announced the opening of the studs of the studs of the public and the people’s studs of the studs.”

At around 16:00 of the same day, the Defendant, as the Chairperson, attended the National Farmers' Meeting held in front of the Southern-gate, from 17:30 to 18:50 of the same day, and obstructed the traffic of vehicles by occupying approximately 32,00 lanes prior to the two directions in order to enter the conference into the luminous plaza where the progress is prohibited, together with approximately 30 meters of the participants in the assembly in front of the entrance of the Gu Office, from 17:30 to 18:50 of the Seoul Metropolitan Government, by moving around 30 meters in front of the two directions.

Accordingly, the defendant conspired with the above participants in the assembly and interfered with the traffic by land.

2. Determination

A. Even if an assembly or demonstration was duly reported pursuant to the Assembly and Demonstration Act (hereinafter “the Assembly and Demonstration Act”), the scope of the initial report is considerably exceeded, or the traffic on the road is significantly violated the conditions under Article 12 of the Assembly and Demonstration Act.
