The defendant is innocent.
Reasons
1. The summary of the facts charged:
(a) Around 14:01 on February 5, 1994, the Defendant’s employee violated the vehicle operation restrictions of the Road Management Office by loading and operating the freight exceeding 45.7 tons of the gross weight of 40 tons of the A truck at a point of 1.5 kilometers in the Gurosan of the Daegu Office of the Korea Road Corporation;
B. On July 22, 1994, the Defendant’s employee violated a restriction on the operation of the vehicle of the road management office by loading and operating the freight exceeding 44.3 tons of gross weight of 40 tons in excess of the gross weight of 40 tons at a 11.1 kilometer point of a 11 kilometer point of a chillline of the Honam Expressway Highway Association;
C. On March 20, 1996, at the control inspection station located in the north-do, Hacheon-dong, Hacheon-dong, Hacheon-do, Chungcheongnam-do, in around 04:10, the Defendant’s employee violated the 11.4 tons of the 2 axis in excess of 10 tons of the restricted axis, 1.4 tons in the 3 axis, 11.0 tons in the 4 axis, 12.0 tons in the 5 axis, 12.0 tons in the 5 axis, and loaded and operated the gross weight exceeding 40.8 tons in excess of the gross weight of 50.8 tons in the vehicle of the road management office;
D. On October 22, 1996, around 19:10, the Defendant’s employee violated the restriction on the operation of the vehicle of the Road Management Agency by loading and operating the freight of more than 10 tons in excess of 14.8 tons, 15.3 tons, 16.5 tons, 14.8 tons, 5 tons, and 14.8 tons in excess of 40 tons in total weight, and loading and operating the freight of more than 67.8 tons in excess of 40 tons in total weight;
E. On March 11, 1997, at around 20:00 Do road 325, the Defendant’s employee violated the restriction on the operation of the vehicle of the road management agency by loading freight of more than 10 tons and exceeding 15.5 tons of 3 stable 15.5 tons, 15.5 tons of 4 stable 16 tons, 15 tons of 5 stable 15 tons, and loading and operating freight of more than 40 gross weight of 68 tons;
f. On July 22, 1998, 10:27 on July 22, 1998, the location of Seoyang-gun, Ulsan National Highway No. 14 of Ulsan National Highway.
