The defendant is innocent.
Reasons
1. The summary of the facts charged:
A. On November 4, 1997, around 17:27, the inspection station at the port-to-land size of the 31st line located on the Gyeongcheon National Road of Gyeongcheon-gun, Gyeongcheon National Road of 31, Gyeongcheon-do. The Defendant’s employee violated the restriction on the operation of the road management agency by loading C truck with freight of more than 10.7 tons on the 2 axis in excess of 10 tons out of the restricted axis, and operating with gross weight of more than 44.73 tons in excess of 40 tons in total weight;
B. Around 00:50 on October 31, 1997, at the Gunr's place of business in the direction of a new road by 19.8 kilometers on thewest Coast Guard, the Defendant's employee violates the restriction on the operation of vehicles of the Road Management Office by loading freight of 1.1 ton on the 2 axis in excess of 10 tons during the restricted axis, and operating the restricted gross weight of more than 5.9 tons in excess of 40 tons;
C. On February 7, 1998, around 19:30, the Defendant’s employee violated the restriction on the operation of the vehicle of the road management office by loading and operating C Trucks on the 5 axis in excess of 10 tons of the restricted axis, in excess of 10 tons of C Trucks;
(d) Around 12:52 on May 27, 1998, at the Busan Masan branch office located in Busan 385.2 kilometers on the Highway in Busan 385.2 kilometers, the Defendant’s employee violated the restrictions on the operation of vehicles of the road management office by loading and operating freight exceeding 11.3 tons on the 2 axis in excess of 10 tons of the restricted axis;
E. On July 1, 1998, around 22:54, 1998, the Defendant’s employee violated the restriction on the operation of the vehicle of the road management agency by loading freight to the fourth axis in excess of 11.65 tons and 11.50 tons of freight on the fifth axis in excess of 10 tons of the restricted axis and operating to the gross weight of more than 43.90 tons in total weight of 43.90 tons;
F. On October 3, 1997, around 20:45, the Defendant’s employees exceed 10 tons of G cargo trucks out of the limitation axis at the regular inspection station for the movement of vessels 33 of the long-distance national highways of Mapo-gun, Mapo-gun, Mapo-gun, Mapo-gun, Mapo-gun, Mapo-gun, Mapo-gun.
