A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. Intrusion upon residence;

A. On April 8, 2019, around 09:05 on April 8, 2019, the Defendant: (a) laid the gate installed in front of the entrance in front of the said victim’s residence; (b) the fence was installed in the front of the entrance; (c) even though the outside person is unable to have access without permission because the fence was installed in the front of the entrance; (d) the Defendant laid the body into the empty space of the fence and entered the front of the entrance; and (e) laid down the gate by hand.

B. On April 9, 2019, around 10:55 on April 9, 2019, the Defendant entering a residence entered the victim’s residential building beyond a fence installed in the victim’s residence while setting up a balring at the boundary of the said garden and the victim’s residence.

C. On July 14, 2019, around 09:30 on July 14, 2019, the Defendant violated his/her residence, and entered the front space of the entrance in the manner same as that of the foregoing 1 in front of the victim’s residence, and opened the entrance with his/her hand.
