Defendant shall be punished by imprisonment for a term of one year and six months.
The defendant shall be ordered to complete the sexual assault treatment program for 40 hours.
Reasons
Punishment of the crime
1. Intrusion upon residence;
A. On August 2017, the Defendant: (a) opened the entrance and door password, which was found to have been included in the Defendant’s residence of the victim Category C of Yeongdeungpo-gu Seoul, Yeongdeungpo-gu, Seoul (Gam, do, 23 years old); and (b) opened the door password, which was found to have been included in the Defendant’s telephone, and intruded into the Defendant’s residence.
B. Around August 10, 2017, the Defendant: (a) opened a cell phone (LG V10, No. 8) in which the victim saws at his residence; (b) opened a cell phone (LG V10, No. 8) in which the victim saws a shower; and (c) intruded the victim’s residence.
C. On August 22, 2017, the Defendant was at the residence of the said victim, and No. 1-B.
In order to replace Samsung GV V10 mobile phones installed by intrusion as stated in paragraph (1) with Samsung Galtha, in order to install a mobile phone A5 mobile phone, the gap released by the victim was accumulated in the other victim's dwelling entrance password and intruded into the victim's residence.
The defendant around December 2017, in his/her residence, and No. 1-C.
In order to replace A5 mobile phones from the defendant Samsung Talthal ju (No. 1) installed by intrusion with the defendant's Samsung Talthal juthy, the difference between the victim's and the victim's out-of-the-counter mobile phone was leaked and intruded on the victim's residence by leakage of the victim's present door password.
E. Around February 2018, the Defendant was at the residence of the said victim, and No. 1-D.
The defendant Samsung Gallon, installed like the defendant Samsung Tallon, in order to connect the excessive wave of the window to the Internet again, the victim's outer cres of the other victim's dwelling cres and intrudes on the victim's residence by leakageing the secret number of the other victim's dwelling cres.
Accordingly, the defendant invadedd the victim's residence more than five times in total.
2. On August 10, 2017, the Defendant violated the Act on Special Cases Concerning the Punishment, etc. of Sexual Crimes (hereinafter “Ameras”) against the Defendant, at around 21:39, when the said victim’s residence, he/she intrudes in advance and takes a bath.
