Punishment of the crime

[Basic Facts] The Defendant served as the Director D of the Gangwon Headquarters of the Korea Railroad Facilities Corporation from July 2010 to June 201, the Defendant is a person who is currently serving as the Head E of the Korea Railroad Facilities Corporation in the Seoul metropolitan area and is deemed as a public official.

F Co., Ltd. (hereinafter referred to as “F”) is a company that manufactures electric installations, etc. to a company located in G, and H working in the above F is a third degree relationship with the Defendant.

I is a person who has worked as a site warden of K Co., Ltd. (hereinafter “K”), a construction contractor for J Railroad Construction No. 11-2 construction works, and L is a person who has worked as a site warden of J Railroad Construction Co., Ltd. (hereinafter “M”), a construction contractor for J Railroad Construction No. 11-3 construction works and other construction works.

The Korea Railroad Facilities Corporation entered into a contract with K and four companies on July 3, 2014 for the construction project at the contract price of KRW 121,722,00,000 for the construction project (hereinafter “instant 11-2 construction project”). K, etc. started the construction project around July 4, 2014 and is performing the construction project on March 3, 2017.

On July 7, 2014, the Korea Railroad Facilities Corporation entered into a contract for construction of the J Railroad Construction 11-3 Section (hereinafter “instant Section 11-3 Section”) and other construction works (hereinafter “instant Section 11-3 Section”) with M et al. around July 7, 2014 at KRW 1,35.2 billion, while M et al. started construction works around July 5, 2014 and continues construction with the aim of completing construction on March 7, 2017.

On June 2015, the Defendant received a request from H to permit F to receive electrical construction contracts from the instant construction sections 11-2 and 11-3. As a result, the Defendant issued orders from H to the high-ranking manager (class 1) of the Korea Railroad Facilities Corporation to manage and supervise the instant construction works. On June 201, F is among the instant construction sections 11-2 and 11-2 and 11-3 Section 1-3.
